By accessing or using the Vivio platform, website, or any related services (collectively, the “Services”) provided by Vivio Life LLC (“Vivio,” “we,” “our,” or “us”), you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our Services.

Vivio provides an AI-powered wellness and activity planning platform designed for use by senior living facilities and their residents. The Services include activity planning tools, resident engagement features, progress tracking, and related functionality accessed through our web and mobile applications.

The Services are intended for use by senior living facility operators, staff, and authorized residents. By using the Services, you represent that you are authorized to do so on behalf of your facility or organization, and that all information you provide is accurate and complete.

Vivio may offer complimentary pilot access to qualified senior living facilities. Pilot terms, including duration and scope, will be agreed upon separately. Vivio reserves the right to modify or discontinue the pilot program at any time with reasonable notice.

You agree to use the Services only for lawful purposes and in accordance with these Terms. You are responsible for maintaining the confidentiality of any login credentials and for all activity that occurs under your account. You agree not to misuse, reverse engineer, or attempt to gain unauthorized access to any part of the Services.

Your use of the Services is also governed by our Privacy Policy, available at vivio.life. We take the privacy and security of resident data seriously. Vivio does not sell personal data to third parties. Data collected through the platform is used solely to provide and improve the Services.

The Vivio platform provides activity and wellness suggestions for general engagement purposes only. The Services are not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before making health-related decisions for residents.

All content, features, and functionality of the Services, including but not limited to text, graphics, logos, and software, are the property of Vivio Life LLC and are protected by applicable intellectual property laws. You may not copy, reproduce, or distribute any part of the Services without our prior written consent.

To the fullest extent permitted by law, Vivio Life LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Services. Our total liability to you for any claim arising from these Terms or the Services shall not exceed the amount paid by you to Vivio in the twelve months preceding the claim, or $100 if no fees were paid.

The Services are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied. Vivio does not warrant that the Services will be uninterrupted, error-free, or free of harmful components.

We reserve the right to update these Terms at any time. We will notify users of material changes by updating the effective date at the top of this page. Continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.

These Terms are governed by the laws of the State of Washington, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Washington State.
